1. Service Refusal: The Provider reserves the right to refuse service to any party.
2. Service Rates: Customer acknowledges that the nature of the provided service and the initial rates and charges have been communicated to him/her. The Provider may modify its rates and charges at any time.
3. Payment: AAVBA products and this contract are dependent upon receipt by the Provider of payment. Payments are due each year on the anniversary of the purchase date. Service will be suspended on accounts whose payments become 30 days past due. Accounts that are not paid by the customer may be turned over to a collection agency for collection. The Provider reserves the right to temporarily deny service or terminate this Agreement upon the failure of Customer to pay charges when due. However, such termination or denial will not relieve Customer of responsibility for the payment of all accrued charges.
4. Refund and Disputes: All payments to Provider are non-refundable. All overcharges and billing disputes must be reported within 90 days of the date the dispute occurred.
5. Account Cancellation: All requests for canceling accounts must be made via our Members Area and must be confirmed via email with at least 30 days notice prior to Customer’s next billing cycle. After a cancellation is confirmed all of the Customer’s data on the Provider’s server will be removed.
6. Service Suspension: The provider reserves the right to suspend the account of any customer if it is determined that the Customer's account is the source of a violation.
7. Disclosure to Law Enforcement Agencies: Provider prohibits the use of its services for illegal activities. Therefore, Customer agrees that the Provider may disclose any and all Customer information requested by any law enforcement officer or agency.
8. Reselling Own Account: Customers are not permitted to store, resell or give away their account to any other person while using the services of the Provider.
9. Indemnification: Customer indemnifies Provider for any violation of the Terms of Service that results in loss to Provider or the bringing of any claim against Provider by any third-party. Customer agrees to defend, indemnify and hold harmless the Provider against liabilities arising out of:
   1. Any injury to a person (or persons) or property (or properties) caused by any products sold and/or distributed in connection with Provider’s server or services.
   2. Any material supplied by customer infringing or allegedly infringing on the proprietary rights of a third party or copyright infringement.
10. Disclaimer:
    1. The Provider will not be responsible for any damages the Customer may suffer.
    2. The Provider makes no warranties of any kind, expressed or implied for provided services.
    3. Responsibility of Content: Customers are solely responsible for the content stored within his/her account on Provider's server.
11. Policy Amendments: The Provider reserves the right to modify or update its policies at any given time.
12. Use of Material: The Provider provides text, graphics, logos, and other multimedia on this web site (“CONTENT”) for informational purposes only. The Provider permits you, the user to view this CONTENT and print this CONTENT for your own personal use. All other uses, including the distribution and/or modification of any of the CONTENT is strictly prohibited

FAILURE TO FOLLOW THE TERMS AND CONDITION STATED WILL BE USED AS GROUNDS FOR IMMEDIATE ACCOUNT SUSPENSION AND IN EXTREME CASES ACCOUNT CANCELLATION.
